Terms and Conditions 

By booking activities with Tittesworth Watersports LTD via the website, email, phone or in person you agree to the declaration highlighted below as well as the booking Terms and Conditions relevant to your booking. 

Declaration 

I have read and accept the Terms and Conditions relating to this booking, especially those relating to cancellation – see below. 

Tittesworth Water Sports Centre accepts its responsibility to make its courses and activities as safe as is reasonably practicable. However, adventurous activities are inherently hazardous and cannot be completely risk free, however hard we try. Accidents can happen without any contributory negligence from the centre or its staff. The centre can accept no responsibility for loss or damage to personal property or for personal injury not arising as a result of its own act or default. I understand and accept the above statements and accept that I have a responsibility to take careful note of instructions and to act in a way that will minimise the likelihood of injury. I am physically fit for the course or activity and will inform the centre before the activity begins of any special medical conditions that might affect my safety.

 This agreement is made between you (the customer or parent/guardian (if under 18) as defined in the booking process – online, email or phone) and Tittesworth Water Sports Ltd, hereby referred to as us/we, and shall be formed when we acknowledge acceptance of your booking by form of web booking or payment. 

The conditions below may only be waived in special circumstances, but only in writing from us. 

When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them. 

General Booking Conditions 

Participants Physical Health 

When participating in activities or courses you should expect to be involved in adventurous and sometimes strenuous activities and so you should be of good general health. Any prior injuries and/or serious illnesses must be declared on the day to the instructor taking the session or course. If you are aware that an adaption to the planned activity or course will need to be made please get in touch with the centre beforehand. You must satisfy yourself that taking part in the activity or course is within your own capabilities. We reserve the right to refuse a booking on medical grounds if it is considered to be detrimental to the safety and smooth running of the activity or course. 

 Safety Provision 

By booking an activity or course with us this signifies your acceptance that the coach(es) in charge of your session has the authority to make decisions affecting the attendees or individuals. The coach may require an individual or individuals to leave the activity or course if they believe that a person or person’s health is at risk, if an illegal act is committed, or behaviour may become, or has been, detrimental to the safety, enjoyment or well-being of the group. Participation in adventurous activities entails some risk of injury. All staff employed by us are trained and appropriately qualified to run activities and courses and will at all times proceed in a manner to limit the risk of injury. However, you accept that accidents and injuries can happen. All bookings are made on the basis that you will observe the safety policies, notices or instructions set by us at all times this includes unsupervised activities such as general hire, self launch etc. 

Kit and Equipment 

We will provide you with the appropriate kit for your activity or course as well as a list of suggested additional personal kit to bring with you. We or our designated coaching staff are not under any liability whatsoever in the respect of loss or damage to your personal property, however caused, whilst attending any activity. Where we do provide any equipment for use during the activity, you shall be responsible for the safekeeping of all equipment issued. With the exception of fair wear and tear we reserve the right to charge for equipment that has been lost, damaged or misused. 

 Photography 

By participating in any activity or course you consent to us taking photographs or video of you for the purposes of feedback and personal development. These images remain the property of us and from time to time may be used for marketing purposes. You consent to the use of these images for marketing purposes by us or any company associated with us. If you do not consent to us using your image in this way please notify us of this in writing. 

Under 18s 

If booking as a parent/guardian you agree to your child taking part in the activity or course specified, accept the risks involved and have/will declare any medical conditions that are relevant. You will also provide us with emergency contact details.You agree to your son or daughter receiving emergency medical treatment, including anaesthetic, as considered necessary by the medical authorities present and I give authority to members of staff of the centre to consent to such treatment should I be absent. Tittesworth Watersports LTD provides a duty of care to all under 18’s from the agreed activity start time to finish time, not before or after these agreed times. 

Data Protection 

All information passed to us will be treated as confidential and will only be passed to third parties with your prior consent. You agree that information will be passed to our designated staff, affiliates or British Canoeing and other National Governing Bodies as is appropriate for the running and certification of activities. More information on how we use your information can be found in our Privacy Policy. 

Commercial Use 

If you are a commercial organisation or company and you wish  to use Tittesworth Watersports services such as Self Launch or General Equipment Hire you must contact us and provide us with the following information each time prior to making a booking:

  • Instructor Qualifications relevant to the Sheltered Water Environment, First Aid,
  • Public Liabilty Insurance, Activity Risk Assessments and Operating Procedures.
  • An outline of the type of activity or sessions you wish to run

The Tittesworth Watersports Management Team will then be in touch to discuss your requirements further and whether there are any conflicts of interest with Tittesworth Watersports activity provision. A mutual agreement on the fee to be paid will be made between both parties before the event. Failure to follow the process detailed above will result in no future use.

Payment 

Online Bookings 

Full payment is taken on booking via card payment or gift voucher. 

Group Bookings 

Once the group activity program and activity cost has been agreed on by both parties a deposit invoice (50% of total booking cost) will be generated with up to 30 days to pay. 

A balance invoice will also be generated due 2 weeks prior to your activity date. Participant numbers can be altered prior to the balance invoice being paid at no additional admin charge. If there is a significant alteration in participant numbers between paying the deposit and balance invoice the original activity cost will be reviewed. 

Activities booked with less than 30 days notice will be invoiced in full and due 2 weeks prior to activity. 

The balance of your account will be payable 2 weeks in advance of the activity date. If the balance is not received by this time, we reserve the right to cancel your booking and your deposit will be forfeited. 

We accept payments by cheque, cash or bank transfer or other such means as described on the invoice. Cheques should be made payable to Tittesworth Water Sports Ltd. In the event of your cheque being dishonoured, a charge of £25 will be made to you to cover bank and administrative costs. 

 Amendments to Courses or Activities by Us 

Whilst every effort will be made to adhere to the planned itinerary for your activity or course, it must be realised that changes to the programme can occur from time to time due to factors outside of our control and we accept neither responsibility nor liability for any associated costs, should this occur. As a consequence, we may be forced to alter dates or venues before the activity or course starts and we will inform you of any such changes as soon as we know of them. On assessing the conditions on the day and attendee abilities, we and our coaches may decide to alter any proposed plan or river/venue if it is believed that not doing so would put attendees at unnecessary risk. Some activities or courses require specific river levels, particularly when running advanced courses. We endeavour to plan activities and courses for the time of year that we would expect to get the appropriate amount of rainfall. For water dependant activities a final decision as to the viability of the activity or course will be made 48 hours before the activity or course is due to start. If an activity or course is cancelled at this point then you will be offered an alternative venue or date. If the subsequent date is also cancelled then customers will be given the opportunity to wait for another alternative date or have a full refund. 

 Cancellation 

Cancellation by Us 

Insufficient Bookings - We reserve the right to cancel activities or courses advertised online which do not receive sufficient bookings to make it financially viable to facilitate. Activities or courses with a minimum number of participants required will be clearly identified via our website at the point of booking. We shall notify you of any cancellation no less than 48 hours prior to the commencement of the activity where numbers as a result of either customer(s) cancellation or booked numbers have failed to reach a sufficient minimum. In such circumstances we will not refund travel or accomodation costs that you may have incurred prior to the cancellation. 

Weather Conditions - We reserve the right to cancel activities or courses if the weather conditions on the day are deemed unsafe such as high winds, thunder and lightning, snowfall etc. 

In the event of a cancellation by us you will be offered the choice of either rescheduling to a different date or if mutual dates cannot be agreed, a full refund of the fee paid. 

Cancellation by You 

All bookings are non-refundable. 

If extenuating circumstances it is at the managements discretion to provide you with an alternative activity date or credit note. 

Group Bookings which cancel a booking 6 or more weeks prior to the start of activity, will be provided a 12 month credit note for any monies already paid which can be used on alternative courses/activities provided by us. 

If you are required to leave an activity which has already started at any stage, for whatever reason, you will not be entitled to any refund unless agreed by us.

COVID 19 Cancellation Policy 

Cancellation by Us 

We reserve the right to cancel any form of activity if it is by specific recommendation of the UK Government to do so in order to reduce the spread of the virus. We shall notify you of any cancellation no less than 48 hours prior to the commencement of the activity. 

In the event of cancellation you will be offered the choice of either another booking on a different date or if mutual dates cannot be agreed, a full refund of the fee paid. 

Cancellation by You 

If you are unable to attend your booking with us due to any of the reasons below we shall provide you with either an activity reschedule or if mutual dates cannot be agreed, a full refund of the fee paid per participant affected. 

- Positive COVID19 test from a participant – proof of a positive test will be required. 

- Isolating due to someone else having COVID19 – dependant on current UK Government guidelines regarding the requirement to isolate. 

- Travel restrictions or local lockdown applied to the location you are travelling from to participate in activities.
